The NEWCHEM s.p.a., having its registered office in Milan Via E. De Amicis, 47, as owner of the processing of personal data pursuant to Legislative Decree no. 196 of 30 June 2003 (“Code regarding the protection of personal data”) provides the following information pursuant to Article 13 of Legislative Decree No. 196/2003, concerning the use of personal data of customers and other members of its collected during its activities.

According to the law, the processing of personal data shall follow principles of correctness, lawfulness and transparency and the protection of privacy and the rights of those concerned.

1. Purposes of the data processing

Personal data collected directly from people concerned or by third parties, are processed within the normal activity of the NEWCHEM s.p.a. or by third parties appointed responsible for the following purposes:

1. obligations provided by laws, regulations and community laws as well as regulations issued by authorities or by bodies authorized, the transfer of personal data necessary for such purposes is mandatory and refusal to provide them will prevent us from establishing relationships with NEWCHEM s.p.a..

2. purposes connected with and instrumental to the award and execution of contract for the supply and accessories accounting treatment, tax and banking. The provision of personal data necessary for such purposes is not mandatory, but the refusal to supply may make it impossible for the company to provide the service required;

3. organizational goals and functional activity of the Company, for which the person concerned has to give or not to consent, including promotion and sale of products and services, statistical, marketing, public relations, relationships with other companies, employees, consultants. The provision of personal data necessary for such purposes is not mandatory and the refusal to provide it will have, as one consequence, it is impossible for the company to process personal data for the purposes referred to in this Section 1.3

Any sensitive or judicial data, which is not apparent from books or public records, processed to follow the specific requirements and for the purposes indicated above, will be used only with the written consent of the individual concerned.

2. Methods of processing data

The data will be processed using manual or with the help of computer in a functional to the purposes stated above and to ensure that in any case the security and confidentiality of personal data.

3. Refusal to provide data

The conferment of data is optional, but a refusal to provide such data may make it impossible or partial inability to establish relations with the company or to properly perform the contract or the inability to continue the relationship. The Company, however, reserves the right to assess the consequences of non-disclosure of personal data, undertaking to promptly notify the person concerned in the event that such behavior is not allowed to perform in whole or in part, its contractual obligations.

4. Data communication and scope of dissemination of data

Personal data held by the company, with the consent of the person concerned may be disclosed:

1. Group companies, even abroad;

2. to outsiders, even abroad, for (a) the conduct and management of the relationship (b) compliance with and fulfillment of any requests for sending advertising and promotional material;

3. to businesses abroad that perform control of the company and quality;

4. to enterprises, even abroad, for business needs, commercial or contractual fit in the organization of our society (eg, employees and consultants, institutional bodies, companies or third parties for outsourced activities or outsourcing, banks etc. offer their products or services (eg. insurance, banking, financial);

6. Rights of the person referred to in Art. 7 D. Decree 196/2003

Article. 7 D. Decree 196/2003 confers the possibility of exercising at any time the rights granted by this Article which is given here in full:

“1. You have the right to obtain confirmation of the existence or not of personal data concerning you, even if not yet recorded, and their communication in intelligible form.

2. You have the right to be informed: a) origin of personal data b) the purposes and methods of treatment c) the logic applied in case of treatment with the help of electronic instruments d) of identity of the owner, manager and the representative appointed under article 5, paragraph 2 e) the subjects or categories of subjects to whom the personal data may be communicated or who can learn about them as appointed representative in the State, managers or agents.

3. You have the right to obtain: a) updating, rectification or, when interested, integration of data, b) the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those which need not be kept for the purposes for which the data were collected or subsequently processed c) certification that the operations in letters a) and b) have been notified, as also related to their contents, to those to whom the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate to the protected right.

4. You have the right to object, in whole or in part: a) for legitimate reasons to the processing of personal data, even if pertinent to the purpose of collection b) the processing of personal data concerning him for the purpose of sending advertising materials or direct selling or for carrying out market research or commercial communications. “
